Dear Mr. Abbey,
I have received your recent correspondence regarding my grievance charge against Curtis Karpel for "misconduct". In your January 5, 2018 correspondence, you state that I filed the charge against Karpel for an alleged violation of Article VI (G) of the Club’s By-laws. Karpel confessed, a confession is not an allegation? Despite his admission, you are rejecting my charge for the second time by stating the following;
“The decision of which you complain was made by the Board of Governors, Mr. Karpel is but one of nine members of the Board of Governors. As we found previously, the action of a group, the Board of Governors, is not covered by Article XIV”.
I have read ARTICLE XIV and found no reference as to your above version. What is shocking is that the board and their disciples, believe in such a disgusting elite status and live by it. You have confirmed “WE ARE THE BOARD AND CAN DO ANYTHING WE WANT”. The membership will finally be aware of the existence of such repulsive acts by the board, for the board and their hosts. That makes the entire AD HOCK committee bylaw re-write a sham and is more of a signal that we must rid ourselves of all of the bylaws and start from scratch. To be written by the members and for the members.
Karpel’s confession of violating ARTICLE VI (G) occurred at membership meeting on November 17th 2017. You as the chair of the grievance committee, giving him a free get “out of jail card” for his "MISCONDUCT", is Just more confirmation of the "Board Pay Tribute To".
I was found guilty by you, for sponsoring a website that was adjudicated as being within my legal civil rights by the WIPO. I ended the hearing with a 1 year suspension? Donald Snyder a grievance committee member calling me an “asshole” during my questioning of Karpel ( at which you were only present illegally by phone-hook-up) received a free get “out of jail card”. Snyder was not charged with misconduct. Jeffrey Smith received a 4 week suspension for posting a four letter word. You rejected Judith Silver's grievance charge brought against her by the Rosenbergs for damaging several of their cars with a hammer in her temper tantrum, she received a free get “out of Jail Card”. A payoff to Sid Silver's elite status.
All of the foregoing added more buttress to our argument that Delaire selectively discriminated against me is a continued show of bad faith. Perhaps that and the fact of you confirming that the board is engaged in the feeling that the BOARD CAN DO EVERYTHING IT PLEASES, MEMBERS RIGHTS ASIDE. That too is a positive at the end of the day, as your May 30th, 2017 letter referencing the jurisdiction of the grievance committee. In the referred letter, you stated bluntly that the grievance committee did not have jurisdiction in the grievance matter of Karpel v. Brecker. That letter has turned out to be a positive in our Brecker v. Delaire litigation.
What will the Jury think? What are our members thinking who are not graced with the elite status? That is the real question?
