Brecker Demands Builder Agreements

After his request for information on Builder Agreements was denied, Manfred Brecker has once again had to resort to his attorney to demand the withheld documents, which he is clearly entitled to see.  It's sad to say, but that's the way this whole dispute expanded to its current state.  Read the below posting.  Just shy of one year, the two letters read almost exactly the same.  Has Delaire learned nothing in the past year?

No Guests Allowed on Saturday AM - Maybe all those new non-residents are clogging the course.  It seems like the more we add, the more the deficit grows and the busier the course gets.  I suppose we wil make up the deficits on the increased volume.

Starting Times or No Starting Times???? 

 

Delaire makes a huge deal out of how there are no starting times.  It appears just this way on the Home page of the Delaire website: "walk-on golf (no tee times)"In fact, that is not true.  There are restricted times every weekend, as well as restricted playing time for singles & twosomes throughout the yearIf you can't go out and play at certain times, that is not "walk-on golf".  One day, someone who just paid a million or two for a house is going to take issue with this policy.  Maybe this is because of an excess of Non-resident members.

 

The Delaire Rules & Regulations read as follows:

3.  Playing time:
a.    All courses are closed before 7:30 am.
b.    All courses are available for play only from the 1st tees between 7:30 and 8:00 am.
c.    
No one may start playing golf on Saturday, Sunday and Holidays from 9:30 a.m. to 11:30 a.m.
d.    No one may start playing golf starting the Saturday morning before Christmas until the Sunday after

       January 1st, from 9:30 a.m. to 11:30 a.m.
e.    Twosomes and singles;
                                      1.    May T-off after 1230 any time of the year.
                                      2.    Can T-off and be restricted to only playing  9 holes before 8:00 during:
                                                    a.   All weekends during the winter season.

                                                    b.   The  Saturday  before  Christmas  through  the  Sunday  after New Year’s.
                                                    c.   All other holiday weeks during the winter season.

Delayed Membership - Who Paid Dues?

 

 

January 11, 2018 - In late May, 2017, a couple purchased a home on Live Oak Boulevard, but evidently did not become members until January, 2018.  We were under the impression that it was mandatory you become a member when you purchased the home.  Read the letter I have written to the Membership Chair, Art Newman to try and understand what has taken place in this instance.  Our concern is that all country club and POA dues, fees & assessments have been paid by someone during the 7 month period in question.   We will let you know the outcome once we have received an answer from Art Newman or the Board.

Should we all be concerned anytime we enter onto a Delaire street?  What's this all about?  What needs to be done?  Who's responsible?

Why No Info on Southeastern Golf?

 

Tax Exempt organizations like Delaire are required, annually, to file a Form 990 with the IRS.  Certain disclosures are required, including, the five highest compensated independent contractors that received more than $100,000 of compensation.  Curiously, for the year 2016, Delaire only listed 4 and there is no mention of Southeastern Golf, who we were told, did the golf course renovation.  Click here to see the documentation.  We also included 990s for the years 2010 & 2011, which clearly show large sums paid to the contractor and designer who built the clubhouse.  Delaire CC has once again refused a request for documentation concerning builders’ agreements, so I feel certain they won’t answer me on this one.  Maybe someone else could check with them and let me know why Southeastern Golf isn’t mentioned on this return to the Federal Government.  It appears that Delaire clearly has information that they do not wish for the members to know.  I wonder why.

Do Our Golf Carts Have to Be Registered as Motor Vehicles?

 

On March 16th, Delaire member Howard Kent was issued a citation for driving a non-registered motor vehicle, his golf cart, on Delaire streets.  This is not a joke.  This is noted as a Criminal Violation with Court Appearance Required.  Why haven't we heard anything from the Club or the POA about this?  Does this mean we are all now subject to the same thing?  Speak up Club & POA officials and let us know where this stands.  It is virtually impossible to play the course without driving on the streets.
